01The agreement
These Terms of Service ("Terms") are a binding agreement between you and [COMPANY LEGAL NAME] ("OneLifeLog", "we", "us") governing your use of the OneLifeLog application, API, SMS features, and related services (the "Service"). By creating an account or using the Service you agree to these Terms and acknowledge the Privacy Policy, which explains how we handle your data, including your health data. If you do not agree, do not use the Service.
02What OneLifeLog is
OneLifeLog is a self-experimentation journal: you record video, audio, text, photos, and documents about your own health practices, and the Service — including AI features — transcribes, organizes, and visualizes that material into metrics, experiments, diet logs, habits, insights, and dashboards, with optional sharing to friends and coaches you choose. The Service is a record-keeping and reflection tool for information you decide to track.
03Not medical advice — read this section
- The Service is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or condition.
- AI summaries, extracted metrics, insights, coach-style chat, and questionnaire scores (including GAD-7 and PHQ-9, which are screening instruments only) are informational reflections of what you logged. They are not clinical judgments.
- Always consult a qualified healthcare professional before starting, stopping, or changing any medication, hormone, peptide, supplement, diet, or training protocol. Never disregard professional advice because of something you saw in OneLifeLog.
- Emergencies: the Service is not for emergencies and is not monitored for crisis situations. If you may be in danger or are thinking about harming yourself, call your local emergency number (911 in the US), or the 988 Suicide & Crisis Lifeline in the US, or your local crisis service — immediately.
- Self-experimentation carries real risk. You are solely responsible for what you choose to do with your own body and for complying with laws applicable to any substances you use.
04Eligibility & your account
- You must be at least 16 years old (or the age of digital consent where you live, if higher) to use the Service, and at least 18 to purchase a subscription. [Confirm minimum-age choice with counsel]
- You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account.
- One person per account. You may not use another person's account or record another person's health data without their clear permission.
05Your content & the license you give us
You own your content — recordings, transcripts, entries, photos, and documents. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, and display your content solely to operate, secure, and improve the Service for you — for example: storing recordings, sending audio to a transcription provider, generating your insights, and showing a shared metric to a friend or coach you authorized. The license ends when the content is deleted, except for transient copies in backups until they age out and anything we must retain by law.
- We do not train AI models on your content, and our AI providers process it under API terms that do not use it for training (see the Privacy Policy, section 5).
- You are responsible for having the rights to what you upload — including anyone else who appears in your recordings and any documents you add.
- Feedback you send us about the product may be used without obligation to you.
06AI outputs
The Service uses third-party AI models to transcribe, extract, summarize, converse, and synthesize speech. AI output can be inaccurate, incomplete, or misleading — including mis-transcribed medication names, mis-estimated nutrition values, and mis-read lab numbers. Review flows exist so you can confirm or reject AI suggestions; you are responsible for reviewing AI output before relying on it, and for any decision you make based on it. AI features may be changed, rate-limited by fair usage budgets, or discontinued.
07Acceptable use
You agree not to:
- break the law or infringe others' rights with the Service;
- upload another person's personal or health data without their permission, or record people without any consent the law requires;
- probe, breach, or test the security of the Service, or access data or accounts that are not yours;
- scrape the Service, resell it, or use automated means to bulk extract data other than your own;
- abuse AI features (attempting to misuse the models, evade usage budgets, or generate unlawful content);
- upload malware or content that is unlawful, or use the Service to harass anyone — including friends or coaching clients connected to you;
- misrepresent Service output as professional medical advice when sharing it.
We may throttle, suspend, or terminate accounts that violate this section.
09SMS terms
If you enable SMS features, you consent to receive text messages from us at your verified number — verification codes, the check-ins and reminders you schedule, and assistant replies. Message frequency depends on your settings; message and data rates may apply. Turn SMS off any time in Settings, or reply STOP to opt out of further messages (HELP for help). SMS is not a channel for emergencies and may be delayed or undelivered by carriers.
10Plans & billing
- The Service may offer free and paid plans. Where paid plans are offered, payment is processed by Stripe; we do not store card numbers.
- Auto-renewal: paid subscriptions renew automatically each billing period until cancelled. Cancel any time via the billing portal; cancellation takes effect at the end of the current period, and you keep access until then.
- Except where law requires otherwise, fees are non-refundable. [REFUND POLICY — confirm or replace after the billing setup is finalized]
- We may change prices or plan features prospectively with advance notice; changes apply from your next renewal.
- Feature availability (including AI usage allowances and storage) varies by plan and may be subject to fair-use budgets.
- Taxes may be added where applicable.
11Our intellectual property
The Service — its software, design, and content other than your content — belongs to us and our licensors and is protected by intellectual-property law. We grant you a limited, revocable, non-transferable license to use the Service for your personal (or your coaching practice's) use under these Terms. You may not copy, modify, reverse-engineer, or create derivative works from the Service except where law permits.
12Third-party services
The Service depends on third-party providers (hosting, database, storage, AI models, payments, SMS, email — listed in the Privacy Policy, section 6). Their availability is outside our control, and your use of third-party services (e.g. Google sign-in, Stripe checkout) may also be governed by their terms. We are not responsible for third-party services.
13Termination
- By you: stop using the Service at any time, and request account deletion as described in the Privacy Policy, section 10.
- By us: we may suspend or terminate your access for material breach of these Terms, for unlawful use, to comply with law, or if we discontinue the Service. Unless the breach demands immediate action, we will give you notice and a chance to export your data first.
- Sections that by their nature survive termination (content ownership, disclaimers, liability limits, disputes) survive.
14Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WITHOUT LIMITING SECTION 03, WE DO NOT WARRANT THAT TRANSCRIPTS, EXTRACTED DATA, OR ANY AI OUTPUT WILL BE ACCURATE OR COMPLETE, OR THAT DATA WILL NEVER BE LOST — KEEP COPIES OF ANYTHING YOU CANNOT AFFORD TO LOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
15Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL; (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $100; AND (C) WE ARE NOT LIABLE FOR DECISIONS YOU MAKE ABOUT YOUR HEALTH, BODY, MEDICATIONS, OR PROTOCOLS BASED ON THE SERVICE OR ITS AI OUTPUT. THESE LIMITS DO NOT EXCLUDE LIABILITY THAT CANNOT BE EXCLUDED BY LAW (INCLUDING, WHERE APPLICABLE, LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR PERSONAL INJURY CAUSED BY NEGLIGENCE IN JURISDICTIONS THAT PROHIBIT SUCH EXCLUSIONS).
16Indemnification
You will defend and indemnify us against third-party claims arising from your content (including recordings featuring other people and data you had no right to upload), your violation of these Terms, or your violation of law — except to the extent the claim results from our own breach of this agreement.
17Governing law & disputes
These Terms are governed by the laws of [GOVERNING LAW — STATE/COUNTRY], excluding its conflict-of-law rules, and disputes will be resolved in the courts of [VENUE — COUNTY/STATE/COUNTRY], unless the arbitration clause below applies or your local consumer law gives you mandatory rights or venue in your country of residence (which these Terms do not limit).
[OPTIONAL ARBITRATION CLAUSE — decide with counsel whether to include binding arbitration and a class-action waiver; if included, add a 30-day opt-out right and small-claims carve-out; if not, delete this paragraph]
18Changes to these terms
We may update these Terms. For material changes we will give advance notice in the app or by email; the updated Terms apply from the stated effective date, and continued use after that date is acceptance. If you do not agree, stop using the Service and, if you wish, request account deletion.
19Miscellaneous
- These Terms plus the Privacy Policy are the entire agreement between us about the Service.
- If part of these Terms is unenforceable, the rest remains in effect.
- You may not assign these Terms; we may assign them as part of a merger, acquisition, or asset sale, with notice to you.
- Not enforcing a provision is not a waiver of it.
- We are not liable for delay or failure caused by events beyond our reasonable control.
